DEPENDENT CHILD AND OTHER RELATIVES SPONSORSHIP

The Dependent Child Sponsorship program allows a Canadian citizen or permanent resident who is at least 18 years old to sponsor a dependent child, orphaned close relatives or other relative for Canadian permanent residence. In order to receive a visa through Immigration, Refugees, and Citizenship Canada (IRCC), the sponsor and sponsored person must meet certain requirements. Also, a sponsor must meet set income guidelines. Both the sponsor and the sponsored person must prove that their relationship qualifies under one of the following:

  • Dependent child
  • Orphaned close relatives or
  • Other relative

Certain requirements for the nature of relationship must be met:

Dependent Child: A son or daughter is dependent when the child:

  • a) Is under age 19 and does not have a spouse or common-law partner, or
  • b) Is 19 years of age or older and has depended largely on the financial support of a parent since before age 19 because of a physical or mental condition.

Orphaned close relatives: Means close relatives, related by blood or adoption, such as brothers, sisters, nephews, nieces, or grandchildren only if they meet all of the following conditions:

  • a) They are orphaned,
  • b) They are under 18, and
  • c) They do not have a spouse, common law partner, or conjugal partner

Other relative: Means one relative, related by blood or adoption, of any age. A person is able to sponsor other relative if he/she meets all of the following conditions:

  • a) Do not have a spouse, common-law partner, or conjugal partner, or one of the following living relatives you could sponsor instead:
    • Son or daughter,
    • Parent,
    • Grandparent,
    • Brother or sister,
    • Uncle, aunt,
    • Nephew or niece.
  • b) You do not have any of the above-named relatives who is a:
    • Canadian citizen,
    • Permanent resident, or
    • Registered Indian under the Indian Act.

Note 1: If your relative does not qualify for sponsorship they may still be able to come to Canada as a skilled immigrant through Express Entry.

Note 2: If a sponsor lives in Quebec, he/she must also meet Quebec’s conditions to be a sponsor after Citizenship and Immigration Canada approves him/her as a sponsor. For instance, a sponsor must sign an “undertaking” with the province – a contract that binds the sponsorship.

Not everyone is eligible to sponsor their child or other relative. A Canadian citizen or permanent resident may not be able to be a sponsor if she/he:

  • Sponsored another relative in the past and did not meet the terms of the sponsorship agreement
  • Is in default of alimony or child support payments
  • Got government financial help for reasons other than being disabled
  • Was convicted of a violent crime, any offence against a relative or any sexual offence
  • Depending on details of the case, such as
    1. a) The type of offence
    2. b) How long ago it was and
    3. c) Whether a record suspension was issued
  • Did not pay back an immigration loan, made late payments or missed payments
  • Is in prison, or
  • Has declared bankruptcy and has not been released from it yet

Furthermore, to sponsor certain relatives, a sponsor must meet set income guidelines. and agree in writing to give financial support to his/her relative and any other eligible relatives coming with them for up to 10 years, depending on their age and how they are related.

PROCESSING TIMES

The sponsorship applications are reviewed in the Case Processing Center in Mississauga, Ontario (CPC-M). To process application for dependent child might take around 16 months and for adopted child or other relative – around 34 months (includes assessment of sponsor).
